In this case, the firm’s client was injured while unloading materials from a truck at his place of work. His employer did not carry workers’ compensation insurance but instead had a benefit plan that allowed for arbitration.
Following his injury, the client signed a release waiving his rights to file legal action against his employer, but he was not aware of the implications of signing. As a result, the arbitrator initially ruled against Kurt Arbuckle’s client.
Nonetheless, Arbuckle persevered. He filed for the case to be reviewed by the District Court, which ruled in his client’s favor. In response, the client’s employer filed for appeal to the Court of Appeals, then the Supreme Court. The Supreme Court ruled in the client’s favor, and the case was sent back to the District Court. Again, the District Court ruled for the client.
Before the case was sent back to the arbitrator, Arbuckle was able to negotiate a settlement of $250,000 in addition to the client’s medical bills, which totaled more than $80,000.
