Text-to-911 Program Unveiled, But Not Available Throughout Texas

May 22, 2014 By karbuckle2016 Leave a Comment

Text to 911 | Car Accident & Personal Injury Attorney | Houston, TX | Kurt Arbuckle, P.C.The Federal Communications Commission unveiled a much-anticipated program in May: Text-to-911. Working in conjunction with mobile phone service providers, the first phase of the program allows the public to contact 911 during an emergency. The FCC reminds the public it is still better to call 911 versus texting, saying, “if you are able to make a voice call to 911, and if it is safe to do so, you should always make a voice call to 911 instead.”

This service will put into practice the habit that some consumers have made of texting 911 in order to alert emergency response teams. [Read more…]

GM Recall – Texas Drivers Not Accountable for Car Accidents Caused by Defects

April 28, 2014 By karbuckle2016 Leave a Comment

Car Crash | Houston Car Crash Attorney | Kurt Arbuckle, PCFollowing the voluntary recall of several makes of GM vehicles, this article appearing in the New York Times spells out a troubling trend from both the automaker as well as with the agency charged with its oversight. The National Highway Transportation Board (NHTB) received over 260 consumer complaints regarding vehicles that either stalled during operation or completely shut down. Many drivers reported stalling during operation on the highways. Tragically, 13 people have died as a result of accidents caused by the defects.

The article details the history of the complaints lodged with the NHTB, the first having been submitted in 2003. According to the article, “The complaints… involved six G.M. models that the automaker is now recalling because of defective ignition switches that can shut off engines and power systems and disable air bags.”

GM manufacturers who knew about the defects will likely face liability, as the faulty manufacturing was the ultimate cause of the accidents and the harm to the drivers. The drivers of the defective cars, however, will not be held liable. [Read more…]

SXSW Car Crash: Don’t Bet on Car Insurance to Cover Damages

April 14, 2014 By karbuckle2016 Leave a Comment

Car Crash | Houston Car Crash Attorney | Kurt Arbuckle, PCThe South by Southwest (SXSW) festival, held annually in the great state of Texas, was marred by violence this year when a vehicle plowed into a crowd of bystanders.

At least two people have been reported dead, with several dozen having been admitted to the hospital with injuries. The driver was apparently fleeing the police, who had initially pulled him over for suspected driving under the influence. Police eventually apprehended the unidentified man after he turned the car into the congregation of bystanders.

While this violent act took place in Austin, all Texas drivers and pedestrians face the possibility of becoming car accident victims. Houston motorists should know the state’s limits on insurance payouts for both intentional and negligent acts.

If you become injured in a car accident in Texas, would you be guaranteed to collect from the driver’s insurance? [Read more…]

Whose Fault Is It Anyway?

February 19, 2014 By karbuckle2016 Leave a Comment

Car accident | Personal Injury Attorney | Houston, TXAccidents are often caused by more than one person, but under Texas law, a person can’t be held financially responsible for an accident unless they were the proximate cause of the accident. We’ll get to the definition of proximate cause later, but here’s an example that will illustrate the problem pretty clearly.

A Baytown, Texas family lost its mother in the weeks before Christmas when a Walmart shoplifter fleeing security caused a fatal car crash. [Read more…]

Hybrid Vehicle Safety

December 6, 2011 By karbuckle2016 Leave a Comment

Did you know the first hybrid engine was invented in 1899?  Since 1999 over 1.5 million hybrid vehicles have been sold in the US.  A hybrid car still has a gasoline (or diesel) engine, but it also has a high power battery that at times takes all or part of the load off the gasoline engine.  As we all know, this saves fuel and is the main selling point for these vehicles.  It takes less fuel to produce the electricity to recharge the battery than to put the equivalent amount of gas in the car.
